The short version
Sphere is a food and calorie tracking app operated by Upstory, LLC. These terms are the agreement between you and us when you use it. Use Sphere for your own tracking, treat its numbers as estimates rather than medical guidance, and we will keep running it as well as we can.
Your account
You need an account to use Sphere, and you need to be at least 13 years old. Keep the email, Apple ID, or Google account you sign in with secure, because anyone who can reach it can reach your food log. Accounts are for one person. Please give us accurate information about yourself, since your height, weight, age, and activity level are what your calorie and macro plan is calculated from.
Nutrition information is an estimate, not medical advice
This is the most important thing on this page. Sphere gives you calorie and macro estimates. They come from public nutrition databases, from our own catalog, and in some cases from AI analysis of a photo or a description, and every one of those can be wrong or incomplete. Portion sizes in particular are approximations.
Sphere is not a medical device and we are not doctors, dietitians, or nutritionists. Nothing in the app is medical advice, diagnosis, or treatment, and the calorie and macro targets it calculates are a general formula applied to the numbers you entered, not a plan designed for your body or your health. Talk to a qualified professional before making significant changes to how you eat, and especially if you are pregnant, managing a medical condition such as diabetes or heart disease, taking medication affected by diet, or have a history of disordered eating. If you are struggling with an eating disorder, please reach out to a professional rather than relying on a tracking app.
Using Sphere
Please do not:
- Break the law with it, or use it to harm or harass someone.
- Try to break into other people's accounts or our systems, or probe them for weaknesses without asking us first.
- Scrape, bulk export, or resell our food catalog, or use it to build a competing database.
- Hammer our servers with automated traffic beyond normal personal use.
- Resell or sublicense access to Sphere.
We can suspend or close an account that does these things. If you find a security problem, please email us rather than exploiting it. We will not pursue you for reporting something in good faith.
Subscriptions and payment
Sphere is free to use for logging. Some features require a paid subscription, which is sold and billed by Apple through the App Store. We never see your payment details.
Subscriptions renew automatically until you cancel. Cancel in iOS Settings under your name, then Subscriptions. Cancelling stops the next renewal and leaves your access running until the end of the period you already paid for. Refunds are handled by Apple under their policies, not by us, though you are welcome to email us and we will help where we can. Deleting your Sphere account does not cancel an Apple subscription. Cancel it separately.
If we change subscription pricing, the change applies to future renewals and we will tell you before it takes effect.
Promo codes
Promo codes are offered at our discretion, have no cash value, and can be limited, changed, or withdrawn at any time. We may cancel access granted by a code that was shared publicly, obtained improperly, or used in a way it was not intended for.
Connected AI assistants
You can connect Sphere to Claude, ChatGPT, and other AI assistants. When you do, that assistant acts on your instructions against your own account, and anything it logs, changes, or deletes counts as your action. Assistants can misunderstand a request, so check your log if something looks off. Your use of the assistant itself is governed by that company's own terms and privacy policy, and we are not responsible for what it says or does. You can disconnect it at any time from that assistant's settings.
Your data and ours
Your food logs, weight history, goals, and photos are yours. You give us permission to store and process them for the purpose of running Sphere for you, which is described in our Privacy Policy. Sphere itself, including the app, our food catalog, and our branding, stays ours.
Availability and changes
We add, change, and occasionally remove features. We will avoid breaking things you rely on, but Sphere is provided as it is and we cannot promise it will always be available, uninterrupted, or free of errors. Planned or unplanned downtime happens.
Ending your account
You can delete your account at any time in the app under Settings, Account, Delete Account. We can suspend or close an account that breaks these terms, and we will tell you why unless we are legally unable to. If we ever shut Sphere down, we will give you reasonable notice and a way to get your data out.
Disclaimers and limits
To the fullest extent the law allows, Sphere is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Some places do not allow these exclusions, in which case they do not apply to you and you keep whatever rights your local law gives you.
Governing law
These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law rules. Disputes go to the state or federal courts located there, and you and we both agree to that venue. Nothing here takes away consumer protections you have under the law where you live.
Changes to these terms
If we make material changes, we will update this page and the date above, and give notice in the app where the change matters. Continuing to use Sphere after a change means you accept it.
